EFFECTIVE DATE AND INTRODUCTION

This Privacy Policy describes how AccuGuard Franchising, LLC (“AccuGuard,” “we,” “us,” or “our”) collects, uses, and discloses information about you when you visit AccuGuardFranchise.com and any related pages or subdomains we operate (collectively, the “Site”). By using the Site, you agree to the practices described in this Privacy Policy.

This Privacy Policy supersedes and replaces in its entirety any prior privacy policy previously published on or in connection with the Site as of the Effective Date above.

AUDIENCE AND CHILDREN’S PRIVACY

The Site is directed to prospective franchisees and other business audiences. It is not intended for children under the age of 16, and we do not knowingly collect personal information from children.

1. INFORMATION WE COLLECT

a. Information You Provide to Us. When you submit a request-information form or otherwise contact us, we collect the information you provide, which may include your first name, last name, email address, telephone number, state, ZIP code, and your responses to qualification questions (such as whether you have access to a specified amount of liquid capital and whether you currently own a restoration business). If you submit a form, we also collect your SMS communication preference based on whether you opt in to receive text messages.

b. Information Collected Automatically. When you access the Site, we and our service providers automatically collect information about the device and technology you use and how you interact with the Site. This may include your IP address, browser type and settings, operating system, device identifiers, referring website or source through which you entered the Site, the pages and content you view, the dates and times of your visits, and similar usage data. When you submit a form, we may associate your IP address and entry source with your submission where that information is available.

c. Demographic and Interest Data. We use analytics platforms, including Google Analytics, that may provide aggregated demographic and interest information about Site visitors, such as approximate age range, gender, general location (derived from IP address), language, and interest categories. This data is collected only for users who have consented to sharing it through their Google account settings and is subject to data thresholds and other privacy protections applied by Google.

2. COOKIES AND SIMILAR TECHNOLOGIES

We use cookies and similar tracking technologies to operate, secure, analyze, and improve the Site, and to measure the performance of our marketing and advertising campaigns. Cookies are small data files stored on your device.

We currently use Google Analytics, which uses first-party cookies to distinguish unique users and sessions. For example, Google Analytics sets a cookie named “_ga” used to distinguish users and a “_ga_[container-id]” cookie used to persist session state, each with a default expiration of up to two years. When linked to a Google Ads account, additional cookies may be set to help measure interactions with our advertising.

We may add, remove, or change the cookies and tracking technologies we use over time, including additional analytics, advertising, retargeting, conversion-measurement, and performance-measurement tools, without separately notifying you each time. The categories of cookies we may use include:

  • Strictly Necessary Cookies, which are required for the Site to function.
  • Analytics and Performance Cookies, which help us understand how visitors use the Site.
  • Advertising and Measurement Cookies, which help us deliver and measure marketing and advertising campaigns.

You can control cookies through your browser settings and, where available, through opt-out tools offered by the relevant providers. Google offers an opt-out browser add-on and account-level controls for Google Analytics and Google signals. Disabling cookies may affect the functionality of the Site. We honor browser-based opt-out signals where required by applicable law.

3. HOW WE USE INFORMATION

We use the information we collect to:

  • respond to your inquiries and provide information about AccuGuard franchise opportunities;
  • contact you by email and telephone, and by SMS if you have opted in, including for sales follow-up by our team;
  • evaluate prospective franchisee qualifications;
  • operate, maintain, secure, and improve the Site;
  • analyze Site usage, measure and optimize our marketing and advertising campaigns, and understand our audience; and
  • comply with legal obligations and enforce our Terms of Use.

4. EMAIL AND SMS COMMUNICATIONS

If you submit a form, we will send a confirmation email to the address you provide, and our sales team may use that email address and the telephone number you provide to contact you about franchise opportunities.

We will send SMS (text) messages only if you affirmatively opt in to SMS communications when you submit a form. Message and data rates may apply, and message frequency may vary. You may opt out of SMS messages at any time by replying STOP, and you may unsubscribe from marketing emails using the unsubscribe link in those emails. Opting out of marketing communications does not affect transactional or relationship messages, such as responses to your direct inquiries.

5. HOW WE SHARE INFORMATION

We do not sell your personal information for money. We may share information as follows:

  • Service Providers. With vendors that perform services on our behalf, such as website hosting (our Site is hosted by WP Engine), analytics providers (such as Google), advertising and marketing platforms, email and SMS delivery providers, and CRM and customer-communication tools.
  • Affiliates and Franchise Network. With our affiliated companies and within the PuroClean/Purofirst/AccuGuard franchise organization for the purposes described in this Policy.
  • Legal and Protective Purposes. When required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of AccuGuard, our users, or others.
  • Business Transfers. In connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets.

Some of our analytics and advertising partners may use cookies and similar technologies to collect information about your online activities across websites and over time. Depending on your jurisdiction, this activity may be considered “sharing” for cross-context behavioral advertising or a “sale” of personal information under applicable law, and you may exercise the rights described in Section 7.

6. DATA RETENTION AND SECURITY

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, to comply with our legal obligations, resolve disputes, and enforce our agreements. We maintain reasonable administrative, technical, and physical safeguards designed to protect the information we collect. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. YOUR PRIVACY RIGHTS

Depending on where you reside, you may have rights regarding your personal information under applicable state privacy laws, which may include the right to:

  • request access to or a copy of the personal information we hold about you;
  • request correction of inaccurate personal information;
  • request deletion of your personal information;
  • opt out of the sale or sharing of personal information and of targeted/cross-context behavioral advertising; and
  • not be discriminated against for exercising your rights.

To exercise any of these rights, contact us using the information in Section 10. We will verify your request as required by law and respond within the timeframe required by applicable law. You may use an authorized agent to submit a request where permitted.

California Residents. If you are a California resident, you have the rights described above under the California Consumer Privacy Act, as amended. We do not knowingly sell or share the personal information of individuals under 16 years of age.

Nevada Residents. Nevada residents may opt out of the sale of certain covered information by contacting us at the address in Section 10.

8. THIRD-PARTY LINKS

The Site may contain links to third-party websites and services that we do not control. This Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party sites you visit.

9. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. When we do, we will revise the “Effective Date” above. Material changes will be reflected by posting the updated Policy on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Policy.
